1. Scope
This addendum applies to all content uploaded to VPQ that features individuals under the age of 18 ("minor athletes"). It supplements the VPQ Terms of Service and Community Guidelines.
In the event of a conflict between this addendum and the Terms of Service, the Terms of Service control. All terms not defined in this addendum have the meanings given in the Terms of Service.
2. Uploader Responsibility and Content Standards
2.1 Public Event Content
VPQ is designed for sharing sports content captured at public or semi-public events, including games, tournaments, practices open to observers, and similar athletic activities. When minors appear incidentally in content captured at these events — as players, participants, or attendees — no individual uploader authorization from each minor's parent or guardian is required, provided the content is captured and shared in good faith and in a manner consistent with these guidelines.
By uploading content to VPQ, you represent that the content was captured in a setting where filming was reasonably expected by participants and attendees.
2.2 Content You Are Permitted to Upload
You may upload content featuring minors if:
- the content was captured at a public or semi-public sporting event, practice, or related athletic activity where filming is customary and visible;
- the content depicts minors in the context of athletic participation (e.g., gameplay, warm-ups, celebrations, team activities) and does not focus on any minor in a manner unrelated to their athletic participation; or
- you are a parent, guardian, coach, team official, or event organizer uploading content from an event you attended or organized in that capacity.
2.3 Content Standards for Minors
Regardless of the setting, all content featuring minors must:
- depict minors only in the context of their athletic participation or event attendance;
- not include content that is sexually suggestive, demeaning, or that places a minor in an unflattering or harmful context;
- not include personally identifying information about a minor beyond what is visible in the footage itself (e.g., name on a jersey, team affiliation); and
- comply with all applicable laws, including those governing the recording and distribution of content involving minors.
2.4 Removal Requests
VPQ respects the rights of parents and guardians. Any parent or legal guardian of a minor appearing in uploaded content may submit a removal request to vpq@vpq.app. VPQ will review and process valid removal requests. Removal requests will be honored where the content does not meet the standards in Section 2.3, or at VPQ's discretion when a parent or guardian objects to their child's appearance in a specific upload.
2.5 Uploader Responsibility
You are responsible for ensuring that content you upload complies with these guidelines and all applicable laws. If your upload is the subject of a valid removal request or legal claim arising from your failure to comply with these guidelines, you may be held responsible for resulting damages. VPQ reserves the right to remove any content at its discretion.
3. Athlete Likeness Rights
Minor athletes and their families retain all rights to their name, image, and likeness ("NIL rights") as provided by applicable state and federal law. The license granted to VPQ in the Terms of Service does not transfer or diminish these rights.
Uploaders must respect the NIL rights of all athletes featured in their content. Uploading content to VPQ does not grant the uploader any commercial rights to the name, image, or likeness of any athlete depicted in that content.
VPQ acknowledges that the landscape of athlete NIL rights, particularly for minor athletes, continues to evolve. We will update this policy as needed to reflect changes in applicable law.
4. Commercial Use Restrictions
Content uploaded to VPQ may not be commercially redistributed, licensed, or sold by any party without the express written consent of the original uploader.
For content featuring minor athletes, commercial redistribution additionally requires the written consent of the minor's parent or legal guardian.
VPQ's own use of uploaded content is governed by the license grant in the Terms of Service.
5. Content Removal Requests
Parents, guardians, or minor athletes (upon reaching the age of majority) may request removal of content featuring the minor by contacting vpq@vpq.app with the subject line "Minor Content Removal Request."
Include the following in your request:
- A link to or description of the content
- Your relationship to the minor (parent, guardian, or the individual upon reaching age of majority)
- Contact information for follow-up
VPQ will process removal requests within 30 days of receipt.
6. Content Standards for Minor Athletes
All content featuring minor athletes is subject to the full VPQ Community Guidelines. In particular:
- Content that sexualizes, exploits, or endangers minors in any way is subject to the zero-tolerance policy and will result in an immediate permanent ban and a report to the National Center for Missing & Exploited Children (NCMEC).
- Content depicting minors in unsafe or inappropriate situations will be removed.
- Tags, labels, and descriptions applied to content featuring minors must be appropriate for all ages.
